Terms
1.General Provisions
1.1.This Public Offer (hereinafter the “Offer”) constitutes a formal proposal by NELE Charitable Institution for Support to Adults with Cancer - Find Your Path (a non-entrepreneurial (non-commercial) legal entity registered in accordance with the laws of Georgia with identification number: 404624652) (the “Organization”, "we", "us", or "our"), to any natural person (hereinafter the “Donor”), to conclude a “Donation Agreement” under the terms and conditions set forth below.
1.2.In accordance with the Civil Code of Georgia, this document is a Public Offer. Acceptance of this Offer occurs when the Donor performs actions aimed at transferring funds to the Organization’s account (the “Acceptance”).
1.3.By making a donation, the Donor confirms they have read, understood, and fully agree to all terms of this Offer without any exceptions or modifications.
2.Subject of the Agreement
2.1.Under this Agreement, the Donor voluntarily transfers funds (the “Donation”) to the Organization to support the Organization’s activities.
2.2.The primary purposes of the Organization’s activities are determined in its incorporation documents as follows:
Organizing charitable events aimed at providing comprehensive support and assistance to individuals under the age of 18 with oncological or suspected oncological diseases and their families, guardians, as well as specialists, experts, doctors, volunteers, medical and other institutions that provide medical and other forms of assistance to patients with oncological or suspected oncological diseases.
Providing assistance in disease prevention and healthcare activities for citizens, as well as promoting a healthy lifestyle and improving the moral and psychological well-being of citizens.
2.3.The Donor determines the amount of the Donation independently.
3.Donation Procedure and Acceptance
3.1.The Offer is considered accepted, and the Donation Agreement is considered concluded, from the moment the Donor transfers funds via the Organization’s website using a bank card, bank terminal, mobile banking or otherwise. By accepting this Offer, the Donor also accepts the Terms of Service as a whole, which also includes the User Agreement and the Personal Data Protection Policy. The Terms of Service are fully incorporated in this Offer and the Donation Agreement.
3.2.By performing the action set out in 3.1 above, the Donor confirms their full and unconditional agreement with all the terms of this Offer.
3.3.All donations are made in Georgian Lari (GEL). If a donation is made in a foreign currency, conversion is handled by the Donor’s bank at their internal exchange rate.
3.4.By making a Donation, the Donor also voluntarily consents to the collection and processing by the Organization of the Donor’s personal data (if any) required for the making of / receiving the Donation through a bank transaction.
4.Rights and Obligations of the Parties
4.1.The Organization is obliged to:
4.1.1.Direct the received funds toward the implementation of the Organization's charitable purposes set out in 2.2 above.
4.1.2.Ensure transparency by maintaining records of all Donations for a reasonable time after they are made.
4.2.The Organization has the right to:
4.2.1.Use a portion of the Donation (within the limits allowed by Georgian law) for administrative expenses required to sustain the organization's activities and for implementation of its charitable projects, including but not limited to the publication and promotion of information about charitable programs and projects.
4.2.2.Change the directions of application of the donations to charitable programs and projects of the Organization at its own discretion;
4.2.3.Redistribute the Donation among those in need at its own discretion;
4.2.4.Refuse or return a Donation if the initial review or further due diligence reveals “red flags,” such as a conflict of interest or a risk of bribery/corruption.
4.3.The Donor has the right to:
4.3.1.Independently determine the amount and frequency of the voluntary donation.
4.3.2.Receive information about the progress of the programs they have supported and about the use of their donations.
4.3.3.Stop or cancel a recurring donation at any time without providing a reason.
5.Refund Policy
5.1.In accordance with the nature of charitable donations, the transfer is considered voluntary and non-refundable.
5.2.A refund may be considered only in the event of a technical error (e.g., double-charging) or if the Donor can prove that the donation was made without their authorization (fraudulent use of card).
5.3.To request a refund for a technical error, the Donor must contact the Organization within 7 business days of the transaction.
6.Representations and Warranties
6.1.The Donor represents and warrants that they have read and understand the contents of the Terms of Service, which includes the Organization’s Personal Data Protection Policy, this Offer, and the User Agreement, including its Clause 12.2 which contains an arbitration agreement.
6.2.The Donor represents and warrants that the donation is permitted under relevant laws.
6.3.The Donor represents and warrants that there is no attempt to disguise the donation or mislead the Organization regarding the identity of the giver or the purpose of the funds.
6.4.The Organization may request banking verification or independent confirmation of account details to avoid cash payments and manage financial risks.
7.Duration and Variation
7.1.This Offer is valid from the moment of its publication on the Organization’s website.
7.2.From time to time, without prior notice to the User, the text of this Offer may be amended or supplemented (including in cases of changes in the applicable legislation). Your continued access and use of the website and performing actions set out in 3.1 above after such variation constitutes your acceptance of the new edition of the Offer. We recommend checking the date and version of the Offer upon each use of the Website and before making each Donation.
8.Final Provisions
8.1.The Organization reserves the right to change the terms of this Public Offer at any time. Changes take effect from the moment they are published on the website.
8.2.If any provision of this Offer is found to be invalid by a court, the remaining provisions shall remain in full force and effect.
8.3.This Offer constitutes an inseparable part of the Terms of Service, as referred to in the User Agreement available at the Organization website: https://www.gotreatcancer.com/ .
